Payments:

Payment is due within 7 days after winning an auction or after placing an order from the website.  After 7 days, the merchandise will be placed back into the inventory for sale.

We accept credit cards only through Paypal. USPS (US Postal Service) money orders ship the next available ship day after receipt.  Personal checks and other money orders are accepted but will delay shipment until it clears the bank.  No other forms of payment are accepted.

Shipping:

For direct sales, we will quote you a shipping cost based on the shipping zip code.  Overnight or 2-day guaranteed shipping is available at additional cost.  Shipping for auctions is listed and is non-negotiable.

We will only ship to confirmed addresses if you pay by Paypal (i.e. the same address as the billing address for the credit card).  We do not ship to business "shipping departments" unless it is part of the confirmed address.

Canadian customers:  This purchase is subject to sales tax and brokerage fees collected upon delivery by UPS and your government.

No warranty is expressed or implied.

All sales final. Returns are accepted only at the discretion of Wintersales Inc. and require a Returned Merchandise Authorization (RMA) number. Returns are subject to a restocking fee (20%).  Without an RMA, merchandise will be refused.  So, please, be sure of size and color.  Of course, if we send you the wrong item, or in some other way are primarily at fault shipping merchandise not as described, it may be exchanged at our cost or refunded with no restocking fee.  Some item descriptions contain specific exclusions to these policies, allowing returns under specific conditions. Please read the descriptions carefully.

Disclaimers:

Mounting of bindings must be done by a professional, certified technician, and adjusted to your height, weight, ability, and the actual ski boot you intend to use. We do NOT pre-mount bindings. (It would not be ethical on our part and may invalidate any warranty that the manufacturer may otherwise offer.)

All information provided comes from the manufacturer or other professional publications. We are surplus resellers and are not ski experts.  Please understand that you, the customer, is responsible for determining suitability for his/her use.

By placing an order you make the following statement.

I understand and acknowledge that skiing, snowboarding, and other alpine activities involve many risks, dangers, and hazards. I recognize that  injuries are a common and ordinary occurrence.  I have made a voluntary choice to participate in these activities despite the risks,  dangers, and hazards that these activities present.  I hereby unconditionally release from any and all liability and agree not to sue, to  indemnify and hold harmless Wintersales Inc, their representatives, agents, affiliates, partners, officers, directors, and employees (collectively  hereinafter “Wintersales”) of and from any claims for damage, injury or death to myself, or to any person or property, arising out of, or in connection in  any way with my participation with the sports of skiing, snowboarding, or any other alpine activities with equipment or accessories purchased from  Wintersales. I have read and I understand this agreement and all of its terms.  I am entering into this agreement freely and  voluntarily and I agree that  it is and shall be binding on me, my heirs, assigns  and legal representatives. I understand that I am entering into a legally binding  contract not to sue Wintersales except for gross negligence and intentional misconduct. I further agree that any claim or suit that I may bring for  any reason against Wintersales shall be submitted to the jurisdiction of the state or federal court in the state in which Wintersales is located and no  other jurisdiction and shall be governed by the laws of that state.  I agree that if any portion of this agreement is determined to be unenforceable by a  court of law, all other parts of the agreement shall remain in full force and effect.

WE DISCLAIM ALL REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, MADE TO YOU OR ANY OTHER PERSON, INCLUDING WITHOUT LIMITATION, ANY WARRANTIES REGARDING QUALITY, SUITABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR OTHERWISE OF ANY SERVICES OR ANY GOODS PROVIDED, AS ALLOWED BY LAW.
